Terms and Conditions for eConnect Cards App, Enterprise and Website

Welcome to eConnect Cards! These Terms and Conditions ("Terms") govern your use of our mobile application ("the App") and the services provided through it.

 

Terms and Conditions for eConnect Cards App, Enterprise, and Website

By accessing or using eConnect Cards, you agree to these Terms. If you do not agree, please discontinue use of the App immediately.

1. Acceptance of Terms

By downloading, installing, or using the App, website, or other content you agree to comply with these Terms and all applicable laws and regulations. If you are using the App on behalf of an organization, your use represents that you are authorized to bind that organization to these Terms.

2. User Accounts and Registration

  • Account Setup: You may need to create an account and provide accurate and complete information. You are responsible for keeping your account details secure.

  • Account Usage: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access.

 

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. Prohibited activities include:

  • Sharing or uploading false, misleading, or inappropriate content.

  • Attempting to hack, interfere with, or disrupt the functionality of the App.

  • Using the App to transmit spam, malware, or other harmful materials.

  • Impersonating another person or business when using the App is a violation.

 

Access and Updates: You can access or update your personal information through the app settings.

  • Opt-Out: You may disable some notifications or delete your account at any time.

  • Request Deletion: You have the right to request the deletion of your data, subject to legal or operational requirements after deleting your account.

 

SMS Consent Notice: By agreeing to our Terms and Conditions in our mobile app, you consent to receive SMS communications from the eConnect Cards App. These messages may include marketing updates, support notifications, announcements, and more. You have the ability to opt out by following the steps in the text message. See sample below:

  • Sample: Thank you for opting into SMS messaging from eConnect Cards App. Message frequency varies. To opt out, text STOP. For assistance, text HELP or visit www.econnectcardsapp.com. Message & data rates may apply.

  • You will no longer receive messages from eConnect Cards App. To opt back in at any time reply START.

  • If you have additional questions regarding SMS messages, please submit a written request to contactus@econnectcards.com or call us at 832-553-9190.

 

4. User Content

  • Ownership: You retain ownership of any business cards, notes, or other content you upload.

  • License: By sharing content through the App, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide the services.

  • Responsibility: You are solely responsible for the content you upload or share using the App.

 

5. Paid Features and Subscriptions

  • In-App Purchases: Some features may require payment or subscription. By purchasing, you agree to the pricing, payment terms, and conditions applicable to those features. All sales are final.

  • Billing and Cancellation: Subscription fees are billed in advance. You may cancel anytime through the app or relevant app store settings. However, no refunds will be provided for the remaining time.

 

6. Intellectual Property

  • Ownership: All trademarks, logos, and content in the App (excluding user content) are owned by eConnect Cards or its licensors.

  • Restrictions: You may not copy, modify, distribute, or use the App's intellectual property without our prior written permission.

 

7. Third-Party Services

The App may integrate with or provide links to third-party services. We are not responsible for the content or services provided by third parties. Your use of such services is subject to their own terms and conditions.

 

8. Limitation of Liability

  • No Warranty: The App is provided "as-is" without any warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.

  • Liability: To the fullest extent permitted by law, eConnect Cards shall not be liable for any damages, including loss of data, revenue, or profits, resulting from the use or inability to use the App.

 

9. Termination

We may suspend or terminate your access to the App at any time, with or without cause, if you breach these Terms or if we decide to discontinue the service. Upon termination, your right to use the App will end immediately.

 

10. Indemnification

You agree to defend, indemnify, and hold harmless eConnect Cards, its affiliates, and its employees from any claims, liabilities, damages, and expenses arising from your use of the App or violation of these Terms.

 

11. Changes to the Terms

We may modify these Terms from time to time. When we make changes, we will notify you through the App or via email. Your continued use of the App after the changes indicates your acceptance of the new Terms.

 

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Texas Jurisdiction, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of Texas Jurisdiction.

 

eConnect Cards Enterprise Version

1. Purchasing and Payment

  • By purchasing the eConnect Cards Enterprise version, you (the "Enterprise") agree to pay all fees and charges associated with the plan selected at the time of purchase.

  • Access to the Enterprise services will only be provided upon successful receipt of full payment.

  • All payments are non-refundable. No chargebacks, cancellations, or partial refunds are permitted after purchase.

 

2. No Refund Policy

  • All sales are final. eConnect Cards App does not offer refunds for any reason once the Enterprise account is activated.

  • Enterprises are strongly encouraged to request demonstrations or consultations before purchasing to ensure the product meets their business needs.

 

3. Verified Icon Usage and Employee Verification

  • The "Verified" icon on employee cards signifies that the Enterprise has confirmed the employee’s affiliation.

  • eConnect Cards App does not independently verify the identity or employment status of any employee associated with the Enterprise account.

  • Enterprises accept sole responsibility for ensuring only current, legitimate employees are listed.

 

4. Responsibility for Content and Information

  • The Enterprise is solely responsible for all information, content, branding, employee profiles, and representations posted, created, or shared via the digital cards.

  • eConnect Cards App bears no responsibility or liability for the accuracy, completeness, legality, or reliability of the information provided by the Enterprise.

 

5. Intellectual Property

  • All software, logos, designs, templates, and content associated with the eConnect Cards App remain the exclusive intellectual property of eConnect Cards App and its licensors.

  • Enterprises may not duplicate, copy, resell, reverse engineer, or otherwise exploit any portion of the App without prior written consent.

 

6. Data Privacy and Security

  • Enterprises are responsible for obtaining all necessary consents and permissions from their employees before entering or sharing employee information in the eConnect Cards App.

  • Enterprises must comply with all applicable data privacy laws related to the handling and storage of employee or customer information shared through the platform.

  • eConnect Cards App maintains reasonable security protocols but does not guarantee absolute protection against all cyber threats.

 

7. Limitations of Liability

  • eConnect Cards App shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use the Enterprise services.

  • In no event shall eConnect Cards App’s total liability exceed the total amount paid by the Enterprise for the applicable subscription term.

 

8. Termination of Services

  • eConnect Cards App reserves the right to suspend or terminate Enterprise accounts at any time for violation of these Terms, misuse of the platform, or illegal activities.

  • No refunds will be issued if termination occurs due to the user or Enterprise’s violation of these Terms.

 

9. Governing Law and Dispute Resolution

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

  • Any disputes arising out of or relating to these Terms shall be resolved exclusively through binding arbitration in Harris County, Texas.

 

10. Agreement

  • By completing the purchase, the Enterprise acknowledges that they have read, understood, and agreed to be legally bound by these Terms and Conditions.

Website Terms of Service for eConnect Cards App

Refund Policy

Thank you for choosing eConnect Cards. Please review our refund policy carefully before making any purchase. By making a purchase within the app, you agree to the terms of this refund policy.

 

1. All Sales Are Final

All purchases made through the eConnect Cards app, including in-app purchases, subscriptions, and one-time payments, are non-refundable. Once a transaction is completed, you will not be eligible for a refund, exchange, or credit, regardless of usage or subscription period remaining.

 

2. Exceptions

We do not provide refunds for any reason including, but not limited to the following:

  • Unused or partially used subscription periods.

  • Change of mind after purchase.

  • Accidental purchases or duplicate orders.

  • Dissatisfaction with features after purchase.

 

3. Managing Subscriptions

If you are subscribed to any of our paid plans, you can cancel your subscription at any time through the app store where you made the purchase (e.g., Stripe, Google Play or Apple App Store).

  • Canceling a subscription prevents future charges but does not refund any part of the current billing cycle.

 

4. Billing Issues and Disputes

If you experience technical issues or believe a billing error has occurred, please contact our support team at ContactUs@econnectcards.com within 7-14 days of the purchase. We will investigate and provide assistance as needed, but refunds will not be provided.

 

5. Third-Party App Store Purchases

All purchases made through third-party platforms (e.g., Stripe, Apple App Store or Google Play) are subject to the respective platform’s terms and conditions. Any requests for refunds must be directed to the platform where the purchase was made, but refunds are not guaranteed under this policy.
